These Terms and Conditions (“Terms”) govern your use of our website and the construction, renovation, and other services we provide as per listed below. By accessing our site or engaging our services, you agree to comply with and be bound by these Terms, in accordance with the applicable laws of India, particularly the Indian Contract Act, 1872, and the Consumer Protection Act, 2019.

1. Services Provided and Scope of Work

We offer a range of construction, renovation, and property maintenance services, which include:

  • Interior & Exterior Painting
  • Wall Putty, Primer, Emulsion, Texture Designs
  • Waterproofing & Ceiling Treatments
  • False Ceiling & POP Works
  • Tiles, Plumbing & Electrical works
  • Minor Carpentry Repairs
  • Shifting & House Moving Assistance
  • Post-Renovation Deep Cleaning
  • Furniture & Modular Kitchen
  • General property maintenance (from roof to garage, and everything in between)

The exact scope of work for each project will be detailed in a formal, written service agreement or quotation provided to the client. Any variations or changes to the scope of work must be agreed upon in writing by both parties and may result in adjustments to the price and timelines.

2. Quotes, Pricing, and Taxes

  • Quotes: Quotes are provided after an initial assessment and are valid for a specified period (e.g., 30 days).
  • Taxes: All prices are subject to applicable Indian taxes, including Goods and Services Tax (GST), as applicable to works contracts.
  • Statutory Cesses: The client understands that a cess for the welfare of construction workers (under the Building and Other Construction Workers Welfare Cess Act, 1996) of up to 1% of the construction cost may be applicable and payable by the employer (client).

3. Payment Terms

Payment terms will be clearly outlined in the individual service agreement. Typically:

  • A mobilization advance or deposit is required upon signing the service agreement.
  • Interim payments are required upon the achievement of specific project milestones.
  • The final payment is due upon satisfactory completion and handover of the work.
  • We reserve the right to charge interest on overdue payments as permitted by Indian law.

4. Client and Contractor Responsibilities

  • Client: The client must provide timely access to the site, necessary utilities (water, electricity), and promptly approve materials and designs to avoid project delays.
  • Contractor: We are responsible for complying with all applicable labour laws, including the Minimum Wages Act, 1948, and ensuring the safety and welfare of our personnel during the project. We are responsible for obtaining necessary contractor licenses and work-related permits, while primary building plan approvals remain the client’s responsibility.

5. Warranties and Defect Liability

We guarantee the quality of our workmanship. A defect liability period (typically 3 months from project completion) will be specified in the service agreement, during which we will rectify any defects that appear at our own cost. Manufacturer warranties will apply to specific materials used.

6. Limitation of Liability and Indemnity

We shall not be liable for any indirect or consequential loss or damage, including loss of profits, arising from the use of our services, except in cases of fraud, wilful misconduct, or gross negligence. We will indemnify the client against any third-party claims arising from our construction activities, provided they are not a result of the client’s negligence.

7. Dispute Resolution (Arbitration)

Any disputes or differences arising out of or in connection with these Terms or any service agreement shall first be attempted to be resolved amicably through discussion. If an amicable settlement is not reached, the dispute will be referred to arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996. The seat of arbitration will be [Shillong], and the decision of the arbitrator(s) will be final and binding on both parties.

8. Governing Law and Jurisdiction

These Terms and any service agreement are governed by and construed in accordance with the laws of India. The Courts in Shillong shall have exclusive jurisdiction to entertain any suit or other proceedings arising out of these terms, should the arbitration clause be deemed inapplicable or an arbitral award require enforcement.

9. Amendments to Terms

We reserve the right to amend these Terms at any time. The updated Terms will be posted on our website, and continued use of our services implies acceptance of the revised Terms.
